4. Coaching Services

4.1 Nature of Services

Our coaching services are designed to facilitate personal and professional development. The Coach is not a licensed therapist, psychologist, or medical professional, and coaching does not substitute for therapy, psychological consultation, or medical treatment.

4.2 Client Responsibilities

As a client, you agree to:

• Be fully responsible for your decisions and actions during and after coaching
• Arrive on time for scheduled sessions
• Maintain confidentiality of all coaching materials
• Complete any agreed-upon assignments or tasks
• Provide honest and complete information

4.3 Confidentiality

All coaching conversations and materials are strictly confidential. The Coach will not disclose any information without the client's written consent, except as required by law or in cases where there is imminent risk of harm to self or others.

5. Payment Terms

5.1 Fees

All prices for services are as listed on our website or as agreed upon in writing. Prices are subject to change with 30 days' notice.

5.2 Payment Methods

We accept payment through:

• M-Pesa
• Bank transfer
• Credit/debit cards
• Other approved payment methods

5.3 Late Payments

Late payments may incur a service charge of 2% per month on the outstanding amount. Services may be suspended for accounts past due beyond 15 days.

5.4 Refund Policy

We offer a 100% money-back guarantee for first-time clients if you're not satisfied after your first session. For ongoing packages:

• Refunds are available within 7 days of purchase for unused services
• Partial refunds may be provided for package cancellations
• No refunds are available for completed sessions

6. Cancellation and Rescheduling

6.1 Client Cancellations

Clients must provide at least 24 hours' notice to cancel or reschedule a session. Cancellations with less than 24 hours' notice will be charged the full session fee.

6.2 Coach Cancellations

If the Coach needs to cancel a session, you will be offered an alternative time or receive a full refund for that session.

7. Intellectual Property

7.1 Company Content

All content on our website, including text, graphics, logos, and software, is the property of James Mwangi Coaching and protected by intellectual property laws.

7.2 Client Materials

While you retain ownership of any materials you provide, you grant us a non-exclusive license to use these materials for providing coaching services.

8. Limitation of Liability

To the maximum extent permitted by law:

• We shall not be liable for any indirect, incidental, special, or consequential damages
• Our total liability shall not exceed the amount paid for services in the 12 months preceding the claim
• We make no warranties, express or implied, regarding our services

9. Termination

We may terminate or suspend your access to our services immediately, without prior notice, for conduct that we believe:

• Violates these Terms
• Is harmful to us, our users, or third parties
• Violates applicable laws

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Kenya. Any disputes shall be resolved in the courts of Kenya.

11. Dispute Resolution

In the event of a dispute, both parties agree to first attempt resolution through good faith negotiation. If unsuccessful, disputes may be submitted to mediation before pursuing legal action.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after changes constitute acceptance of the new Terms.

13. Severability

If any provision of these Terms is found to be unenforceable, such provision shall be modified to reflect the parties' intention. All remaining provisions shall remain in full force and effect.
